These Terms and Conditions (the “Terms”) govern purchases from [Eclectic Eye] (“we,” “us,” or “our”) through [WEBSITE URL] and any associated online storefront. By placing an order, you confirm that you have reviewed and accepted these Terms. If a product listing contains terms that conflict with these Terms, the product listing controls only for that item.

Our inventory consists of one-of-a-kind or limited-quantity secondhand items. Antique, vintage, and collectible merchandise commonly shows age, prior use, patina, fading, scratches, tarnish, repairs, manufacturing variations, odors, wear, or other imperfections. These characteristics may contribute to an item’s history and are not automatically defects.

· Review all photographs, measurements, condition notes, and descriptions before purchasing.

· Photographs are part of the item description. Screen settings and lighting may cause colors to appear slightly different.

· Dimensions and dates may be approximate unless expressly stated otherwise.

· Unless a listing specifically states that an item has been authenticated, appraised, tested, or professionally restored, no such representation is made.

· Questions should be submitted before purchase to info@eclecticeye.shop.

ALL SALES ARE FINAL. We do not accept returns, exchanges, or cancellations for buyer’s remorse, fit, color variation, age-related wear, disclosed imperfections, minor measurement differences, or a change of mind. The only store-policy exception is an item that arrives broken as a direct result of transit, subject to Section 7 below. Nothing in these Terms limits any non-waivable right or remedy provided by applicable law.

Prices are shown in US Dollars and may change without notice before an order is placed. Applicable sales tax, shipping, insurance, duties, and other charges will be displayed at checkout when available. The purchaser is responsible for any taxes or import charges not collected at checkout. Payment must be authorized and completed before an order ships. We may cancel or refuse an order due to pricing errors, suspected fraud, inventory errors, or payment issues; if payment has been collected for a canceled order, it will be refunded.

Because most items are unique, adding an item to a cart does not reserve it. An automated order confirmation acknowledges receipt but does not guarantee acceptance. A sale is accepted when we confirm shipment or otherwise expressly accept the order. If an item becomes unavailable after purchase, our obligation is limited to refunding the amount paid for that unavailable item and its associated shipping charge, if any.

Orders will be shipped to the address supplied at checkout. The customer is responsible for providing a complete and accurate address. Estimated handling and delivery times are not guarantees. Carrier delays, weather, customs processing, and other events outside our reasonable control may affect delivery.

· Inspect the package and item promptly upon delivery.

· Do not discard the shipping carton, cushioning, labels, or damaged pieces until a claim is resolved.

· We are not responsible for loss caused by an incorrect customer-provided address, refusal of delivery, failure to retrieve a package, or unauthorized package forwarding, except as required by law.

If an item arrives broken, contact us at info@eclecticeye.shop within three (3) calendar days after recorded delivery. Late or incomplete claims may be denied if the delay prevents us or the carrier from investigating the damage.

Your notice must include:

· Your name and order number;

· Clear photographs of the broken item, all sides of the shipping carton, interior packaging, shipping label, and any visible impact damage; and

· A brief description of the damage and the date the package was received.

You must retain the item, all broken pieces, and all original packaging and cooperate with any carrier inspection or claim. Do not return an item without written instructions from us. After verifying covered transit breakage, we will provide, at our discretion and subject to applicable law, a refund, replacement if a comparable item is available, or another agreed remedy. Approved refunds will generally include the item price and the original standard shipping charge attributable to that item. Expedited shipping, customs charges, and third-party fees may be nonrefundable unless required by law.

This exception does not cover condition issues disclosed in the listing, ordinary age or wear, damage occurring after delivery, improper handling, attempted cleaning or repair, or damage not supported by the required evidence.

A package that is delayed, missing, or marked delivered but not received is not considered “broken in transit.” Notify us promptly so that we can assist with a carrier inquiry where appropriate. Any refund or replacement for loss, theft, or non-delivery will be determined under applicable law, carrier findings, and any shipping-protection terms associated with the order.

Secondhand items may not comply with current safety standards and may contain fragile materials, aged finishes, small parts, lead-based components, or other substances common to older goods. Decorative or collectible items are not represented as safe for food service, children, electrical use, load-bearing use, or any other specialized purpose unless the listing expressly says so. The purchaser is responsible for inspection, cleaning, installation, and safe use. Electrical, mechanical, or structural items should be evaluated by a qualified professional before use.

Our website content, original photographs, product descriptions, logos, and graphics are owned by or licensed to [BUSINESS NAME] and may not be reproduced or used commercially without written permission. Product names and third-party trademarks remain the property of their respective owners and are used only to identify or describe merchandise.

TO THE FULLEST EXTENT PERMITTED BY LAW, ALL ITEMS ARE SOLD “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS. WE DISCLAIM EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, EXCEPT FOR WARRANTIES THAT CANNOT LAWFULLY BE DISCLAIMED. These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules. Any dispute shall be brought in a court of competent jurisdiction located in Carson City, NV, unless applicable consumer law requires otherwise. Before filing a claim, the parties agree to make a good-faith effort to resolve the matter by contacting one another in writing.

We may update these Terms from time to time. Changes apply to orders placed on or after the updated effective date shown above. The Terms in effect when an order is placed will govern that order.
